The following are the general conditions that regulate access to the Web Site, as well as the services and functionalities offered therein, without prejudice to the application of other different conditions or their modification. The General Conditions of Use shown below regulate the access and use of the UpDog Web Site, which is accessed through the main URL https://www.updog.es, as well as through all those addresses that allow direct access to some sections or web pages belonging to the Web Site.

1. Parts

These conditions are subscribed to by UpDog on the one hand, and on the other hand, by any natural or legal person who voluntarily and freely accesses the UpDog Web Site (hereinafter, the “User”).

By simply visiting the UpDog Website, these General Conditions of Use shall apply and the User shall be subject to these General Conditions of Use, without prejudice to the possibility of being subject to other specific conditions.

2. Purpose of the Web Site

The purpose of the Website is to sell pet supplies and to provide information about the products and services offered by UpDog. 4. Special Conditions of Registration

1. Identification of the parties

These Special Registration Conditions are subscribed to by UpDog on the one hand and, on the other hand, by the user, understood as any natural person of legal age who, accessing the Website, has accepted these Conditions and has completed all the steps required to register on the Website (hereinafter, the “Registered User”).

2. Acceptance

It will be understood that the Registered User accepts the Particular Conditions of Registration when he/she clicks on the corresponding registration box during the registration process on the Website.

3. Registration Process

To complete the registration and become a Registered User of the Website, the User must fill in and send the corresponding registration form, after expressly accepting the Privacy and Cookies Policy and the General Conditions of Use, thus providing the information required by the Website, together with a password that must be duly stored.

By completing the corresponding registration form and becoming a Registered User, the Registered User agrees to the following obligations:

UpDog is exempt from any liability arising from the malfunctioning of the Website or any of its services resulting from an accidental circumstance, such as the unavailability of the portal, force majeure, necessary maintenance work or any other cause not attributable to UpDog.

10. General Issues

1. Safeguarding and interpretation

These General Conditions of Use constitute an agreement between the User and UpDog.

If any provision is declared illegal, invalid or unenforceable by the Competent Authority, it shall mean that the same shall be interpreted in the manner closest to the original intention of the provision. However, such a declaration in respect of any provision or provisions shall not affect the validity of the remaining provisions.

UpDog’s failure to require strict compliance with any of the terms of these Conditions shall not be construed as or constitute a waiver by UpDog of its right to require such compliance in the future.

2. Language

The language applicable to these General Conditions of Use is Spanish. If a version in English or another language is offered, it is merely for the User’s courtesy and convenience. Therefore, the User expressly accepts that they are governed by the Spanish version.

In the event of any contradiction between the Spanish version and the version in another language, the Spanish version shall always prevail.

3. Applicable law and jurisdiction

Any relationship between UpDog and the web user shall be governed by Spanish law. In case of conflict in the fulfillment or interpretation of the General Conditions of Use, they will be submitted, with express waiver of any other jurisdiction that may correspond to them, unless another jurisdiction is imperatively determined by law, to the Courts and Tribunals of the User’s domicile. In the event that the user is a legal entity, the jurisdiction shall correspond to the Courts and Tribunals of Madrid.
